Terms of Service

Welcome to Axshun. These Terms of Service (“Terms”) govern your access to and use of the Axshun website, products, services, software, applications, digital content, and related offerings.
Axshun is operated by Axshun LLC, a Wyoming limited liability company (“Axshun,” “we,” “us,” or “our”).
By accessing our website, purchasing or using our products or services, or otherwise engaging with Axshun, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.
1. Our Services
Axshun provides technology, creative, and digital services that may include software and application development, website development, graphic design, branding, video production and editing, digital media creation, artificial intelligence solutions, workflow automation, systems integration, consulting, digital products, and other technology-related services. Axshun also develops and operates products and services of its own, including LinkSIM, our global eSIM and mobile connectivity service. Certain Axshun products or services may be governed by additional terms, agreements, proposals, statements of work, licenses, or policies. When applicable, those additional terms become part of your agreement with Axshun and will control with respect to the particular product or service they govern.
2. Eligibility
You must have the legal capacity to enter into a binding agreement to use or purchase our services. If you use Axshun on behalf of a business, company, organization, or other entity, you represent that you have the authority to bind that entity to the applicable agreement.
3. Accounts
Certain Axshun products or services may require you to create an account. You are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account. You agree to provide accurate and current information and to promptly notify Axshun if you believe your account has been accessed or used without authorization. Axshun reserves the right to suspend or terminate accounts that violate these Terms, applicable law, or the rights of Axshun or others.
4. Purchases and Payments
Prices, payment schedules, deposits, subscriptions, recurring charges, and other financial terms may vary depending upon the product or service being purchased. Applicable pricing and payment terms will be disclosed at the time of purchase or contained in a separate proposal, invoice, statement of work, subscription agreement, or other agreement. Unless otherwise stated, customers are responsible for applicable taxes, fees, and other charges associated with their purchases. Failure to make required payments may result in the suspension or termination of services.
5. Custom Projects
Custom software development, application development, design, video production, automation, consulting, and other professional services may be subject to a separate proposal, quote, statement of work, or project agreement. Such agreements may establish project scope, deliverables, schedules, revision allowances, payment terms, intellectual-property ownership, licensing, maintenance responsibilities, and other project-specific conditions. Changes or additional work requested outside the agreed project scope may require additional fees and development or production time.
6. Intellectual Property
Unless otherwise agreed in writing, the Axshun website, Axshun name and branding, software, technology, designs, graphics, videos, documentation, interfaces, processes, and other materials created or owned by Axshun are protected by applicable intellectual-property laws. Nothing contained in these Terms transfers ownership of Axshun's intellectual property to you. For custom client projects, ownership and licensing of completed work will be governed by the applicable project agreement. Unless otherwise expressly agreed in writing, Axshun retains ownership of its pre-existing technology, tools, frameworks, processes, templates, libraries, methodologies, know-how, and other underlying intellectual property used in performing services.
7. Client-Provided Materials
When you provide Axshun with logos, photographs, video, audio, text, software, data, trademarks, designs, or other materials for use in a project, you represent that you own those materials or have sufficient rights and permissions to authorize Axshun to use them. You grant Axshun permission to use those materials as reasonably necessary to provide the requested services. You are responsible for claims arising from materials you provide to Axshun without the necessary ownership rights, licenses, permissions, or authorizations.
8. Artificial Intelligence and Automated Technologies
Some Axshun services may incorporate artificial intelligence, machine learning, generative technologies, or automated systems. AI-generated or AI-assisted results may occasionally contain errors, inaccuracies, unexpected results, or similarities to independently created material. Customers should appropriately review important outputs before relying upon, distributing, or publishing them. Unless specifically agreed otherwise, Axshun does not guarantee that AI-generated material will be unique, error-free, or eligible for copyright, trademark, patent, or other intellectual-property protection in every jurisdiction.
9. LinkSIM
Axshun develops and operates LinkSIM, a digital eSIM and mobile connectivity service available through LinkSIMS.com. LinkSIM is governed by its own Terms of Service, Privacy Policy, and any other policies presented through the LinkSIM website, application, or service. Your purchase or use of LinkSIM services is subject to those separate terms and policies. These Axshun Terms of Service are intended to govern your interactions with Axshun and Axshun.com and do not replace the terms and policies applicable specifically to LinkSIM.
10. Acceptable Use
You may not use Axshun's website, products, or services to:
• Violate applicable laws or regulations;
• Infringe intellectual-property, privacy, publicity, or other rights;
• Distribute malware, malicious software, or harmful code;
• Attempt to gain unauthorized access to systems, networks, accounts, or data;
• Interfere with the operation or security of our systems or services;
• Engage in fraudulent, deceptive, abusive, or unlawful activities; or
• Use our systems in a manner reasonably likely to damage Axshun, our customers, providers, partners, or other parties.
Axshun may restrict or terminate access when we reasonably believe our products or services are being misused.
11. Third-Party Services
Axshun products and services may integrate with or rely upon third-party platforms, APIs, payment processors, hosting providers, cloud providers, artificial-intelligence providers, software platforms, or other external services. Third-party services may be governed by their own terms, policies, and practices. Axshun is not responsible for outages, changes, restrictions, discontinuation, security incidents, or other circumstances caused by third-party services outside our reasonable control.
12. Availability and Changes
Axshun works to provide reliable products and services, but we do not guarantee uninterrupted or error-free availability. We may modify, update, improve, replace, suspend, or discontinue features or services when reasonably necessary. Where appropriate, we will attempt to provide reasonable notice of material changes affecting paying customers.
13. Refunds and Cancellations
Refund and cancellation policies may vary depending upon the particular product, project, or service. Specific refund, cancellation, subscription, or project-termination terms presented at the time of purchase or contained in a separate agreement will govern that transaction. Except where required by applicable law or expressly stated otherwise, fees for completed work, consumed digital services, delivered digital products, or services already performed may be non-refundable.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Axshun products and services are provided on an “as is” and “as available” basis except for warranties expressly provided in a written agreement. Axshun does not guarantee that every service will be uninterrupted, error-free, completely secure, compatible with every device or third-party service, or suitable for every particular purpose. Nothing in these Terms excludes warranties, protections, or other rights that cannot legally be excluded or limited.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Axshun LLC and its members, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our products or services. Except where prohibited by law or otherwise expressly agreed in writing, Axshun's aggregate liability arising from a particular product, service, project, or transaction will not exceed the amount you paid Axshun for the product or service giving rise to the claim during the twelve months preceding the event giving rise to the claim.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Axshun LLC and its members, officers, employees, contractors, and affiliates from claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful use of our products or services, your violation of these Terms, or materials you provide to Axshun without appropriate rights or authorization.
17. Termination
You may stop using our services at any time, subject to any outstanding contractual, financial, or other obligations. Axshun may suspend or terminate access to a product or service for material violation of these Terms, nonpayment, unlawful activity, security concerns, abuse of our systems, or other circumstances permitted by an applicable agreement or law. Provisions concerning intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution will survive termination where applicable.
18. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles, except where applicable law requires otherwise. Any dispute concerning these Terms will be brought in a court of competent jurisdiction as permitted by applicable law and any separate written agreement between the parties.
19. Changes to These Terms
Axshun may update these Terms periodically to reflect changes to our services, technology, business practices, or legal requirements. When material changes are made, we will update the effective date displayed at the top of this page. Your continued use of Axshun's website or services following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
